Acceptance of these terms
These Terms of Service ("Terms") govern your use of the APMS.ai website https://apms.ai/, the APMS.ai platform and mobile app, and APMS connections to AI assistants such as ChatGPT and Claude (together, the "Services"), provided by APMS AI Innovations Private Limited ("APMS", "we", "us" or "our"). By using the Services you agree to these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to accept these Terms for it.
Where your organisation has a separate written agreement with APMS, that agreement takes precedence over these Terms where the two differ.
The Services
APMS provides machine monitoring, production analytics, vision inspection, robotics and AI tools for manufacturing businesses. The Services collect data from connected machines and devices and present it as live status, reports, alerts and answers.
Accounts and access
- User accounts are created and managed by the administrator of each customer organisation.
- You are responsible for keeping your login details confidential and for activity under your account.
- Tell us or your administrator promptly if you suspect unauthorised use of your account.
- To delete your account, follow the steps on our Account deletion page.
Acceptable use
You agree not to:
- access data or units your organisation has not authorised you to see;
- attempt to break, probe or bypass the security of the Services;
- copy, resell, reverse engineer or build a competing product from the Services;
- upload malicious code, or use the Services for anything unlawful;
- overload the Services, including through automated or excessive requests.
Your data
Your organisation owns the production and machine data it brings into the Services, and the reports, analytics and answers generated from that data for it, which it may use for its own business purposes. APMS owns the APMS software, models and platform. You grant APMS the rights needed to host, process and display your data to provide and support the Services. We handle personal information as described in our Privacy Policy.
AI assistant connections (ChatGPT and Claude)
You may connect your APMS account to an AI assistant, such as ChatGPT (OpenAI) or Claude (Anthropic), using the Model Context Protocol (MCP). The connection is optional.
- Who can connect: any user with an active APMS account issued by their organisation. You connect by signing in with your own APMS account; you must not use someone else's.
- How permissions are enforced: the assistant can only request data your APMS account is allowed to see, for the unit you choose. Your organisation's administrator controls those permissions in APMS.
- Your responsibility: you are responsible for activity through your connection, and for keeping access to your assistant account secure.
- AI answers: answers are generated by the assistant from your APMS data and may be incomplete or wrong. Check important figures in APMS before acting on them, especially for safety, maintenance or financial decisions.
- The assistant provider: your use of ChatGPT or Claude itself is governed by OpenAI's or Anthropic's terms and privacy policy, not by APMS.
- Restriction and disconnection: you can disconnect at any time from the assistant's settings. Your administrator or APMS may restrict or revoke a connection at any time, including if these Terms are breached, an account is removed, or to protect the Services.
Our Privacy Policy describes what the connection uses and stores.
Third-party services
The Services may link to or work with third-party services, such as ChatGPT, Claude, app stores and cloud providers. We are not responsible for third-party services, and your use of them is subject to their own terms.
Intellectual property
The Services, including software, designs, text and trademarks, are owned by APMS or its licensors. Apart from the right to use the Services under these Terms, no rights are granted to you.
Availability and changes
We work to keep the Services available and accurate, but they may occasionally be interrupted for maintenance, updates or reasons outside our control. We may improve, change or retire features over time.
Disclaimers
To the extent permitted by law, the Services are provided "as is" and "as available". APMS does not guarantee that the Services, including AI-generated answers, will be error-free or uninterrupted. The Services support decisions; they do not replace the judgement of qualified people or your safety procedures.
Limitation of liability
To the extent permitted by law, APMS is not liable for indirect, incidental, special or consequential losses, including lost production, profit or data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the fees your organisation paid for the Services in the twelve months before the claim.
Suspension and termination
We may suspend or end access to the Services if these Terms are breached, if required by law, or to protect the Services or other users. Your organisation's administrator can remove your access at any time.
Governing law
These Terms are governed by the laws of India. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute relating to them.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continuing to use the Services after an update means you accept the revised Terms.
